  1. Assurance of Acceptance

A deed poll issued by Charles Burgess serves as documentary evidence of a name change and is widely recognised by various entities in the UK, including government departments such as HM Passport Office and the DVLA, public agencies, corporations, organisations.

In the rare instance where doubts arise regarding the validity of our deed polls, typically due to misunderstandings about legal requirements, we actively support our clients by engaging with the concerned parties until acceptance is achieved.

Should a deed poll issued by us not be accepted by any of the aforementioned entities, we offer a full refund under specific conditions outlined below:

1.1. Liaison with Non-Accepting Entities:

We initiate a refund process only after:

  • Receiving a letter from you stating non-acceptance by the relevant entity.
  • Contacting the entity to verify the reasons for non-acceptance and attempting to facilitate acceptance.

Instances of non-acceptance often stem from misconceptions about deed polls or administrative errors.

Please note that we have not yet encountered a situation requiring a refund under our acceptance guarantee.

1.2. Exceptions to Acceptance Guarantee:

The acceptance guarantee does not apply in the following cases:

1.2.1. Non-UK Record Holders:

  • Guarantee applies only to UK entities, excluding those outside the UK.

1.2.2. Non-British Nationals:

  • Guarantee excludes foreign nationals, irrespective of residence status. Foreign nationals should check the requirements of their country of origin before ordering a deed poll, but we are unable to advise on or guarantee the outcome of using a deed poll to change your name.

1.2.3. Lack of Parental Consent:

  • Guarantee does not apply if necessary parental consent for child applications is not obtained.

 

For​‌‌‌​‌‌ ​‌‌‌​‌​a​‌‌‌​‌​ ​‌‌‌​‌‌child​‌​‌‌‌‌ ​‌‌​​​​application​‌‌​​‌‌,​‌‌​​‌‌ ​‌‌​​​​you​‌‌‌​​‌ ​‌‌‌​​‌must​‌‌​‌‌​ ​‌‌‌‌​​obtain​‌‌‌​‌​ ​‌‌​​‌‌the​‌​‌​‌‌ ​‌‌‌​‌‌necessary​‌​‌​‌​ ​‌‌​‌​​consent​​​‌‌‌ ​​‌‌‌​from​​‌‌​‌ ​​‌​​‌everyone​​​‌‌​ ​​‌​​‌with​​‌​​​ parental responsibility for the child.  If you do not obtain this consent (in writing), your deed poll will not be accepted.  The acceptance guarantee does not apply in this case — it is your own responsibility to determine who has parental responsibility for the child, and to obtain the required consent.

We give information about who will have parental responsibility based on the information you provide in your application, but because of the limitations of that information and the complexity of the law, we cannot guarantee the information we provide will be correct, and nor should the information we give you be interpreted as legal advice.

 

1.2.4. Provision of Incorrect Information:

  • Guarantee is void if inaccurate information is supplied by the applicant.

1.2.5. Improperly Executed Deed Polls:

  • Guarantee does not cover errors in signing, dating, or witnessing of deed polls. A how to guide is provided when your deed polls are posted, it is your responsibility to follow this correctly.

1.2.6. Name Format Incompatibility:

  • Guarantee excludes rejection due to name format issues, such as length, symbols, or numbers.

1.2.7. Unacceptable Names:

  • Guarantee does not apply if the chosen name is deemed unacceptable by the record holder.

Whether a change of name falls into this category will be the subjective opinion of the record holder (or their staff).  However, names of this sort are likely to include anything which:

  • is unpronounceable or incomprehensible
  • is extremely long
  • is vulgar, offensive or blasphemous
  • is chosen for a bet or frivolous purpose
  • is trade-marked (e.g. Red Bull) and is not a (potentially) “normal” name such as Fred Perryor K MAXX
  • is a combination of names which makes up a saying not normally considered to be a name, e.g. Merry Christmas
  • is a presumed title— that is, a first name that gives the impression that you have a title, such as LordBaron, or Princess
  • gives the impression that you have honours, e.g. surnames ending with OBEor VC
  • is a single name — that is, a first name only, with no surname

 

1.2.8. Sequential Updating of Records:

Record holders sometimes require that you provide proof that you are using your name for all purposes, in which case they will want to see additional documentary evidence in your new name.  This is known to be the case when you want to renew your passport in your new name and:

Some organisations — notably the General Medical Council (if you are a doctor listed on the Medical Register), and some financial institutions — insist on seeing your updated passport in your new name, or other additional documentary evidence in your new name, before they change their own records.  The General Medical Council insist on seeing both your old and new passports.

The acceptance guarantee does not apply if a record holder requires additional documentary evidence and your deed poll is rejected.  You will need to update your documents in a certain order, that is, to obtain additional documentary evidence in your new name so you can provide it to the record holder that requires it.

1.2.9. Lack of Mental Capacity:

  • Guarantee is void if the applicant lacks mental capacity for decision-making.
  1. Unacceptable Names

We reserve the right to refuse applications containing names chosen for fraudulent purposes or those potentially violating the law or ethical standards.

We will refuse a deed poll application with any name that:

  • we have reason to believe is chosen with the intention of committing fraud
  • is (potentially) against the law — e.g. anything that promotes racial or religious hatred, derides minority groups, or promotes the use of drugs

 

 

  1. About Our Service

For detailed pricing and payment terms, please refer to our price list. Payment is required upfront before processing begins. We strive to maintain transparency and provide timely updates throughout the application process with 2 automatic notification email’s 1 being an order received conformation email and they other being when we have processed and dispatched your order. We may also follow up in a few days’ time regarding how we done & also chance for us to leave a review.

How long until your order gets processed?

We aim to process your application and despatch the order within 2 working days of receiving it.

We also offer a priority service, for an additional fee of £5.  With the priority service, applications are processed and despatched the same working day — provided your order was received before 12 p.m. If your order is received after 12 p.m., we treat it as though it had arrived the following day. Working days are Monday – Friday.

Delivery

Charles Burgess Deed Polls use Royal Mail as the carrier for all deed poll documentation posted to addresses within the U.K., Isle of Man, and Channel Islands, and for any other correspondence when it cannot be carried out by e‑mail.  We will deliver your deed poll documentation as per the delivery method you request in the application for. Deed poll documentation is delivered in board-backed envelopes.  For your privacy, there is no indication of the contents of the envelope from the outside.

 

  1. Cancellations, Returns, Corrections, and Refunds

We accommodate cancellations and returns as long as processing of your order hasn’t started, if you do with to cancel, you need to do this is in writing to: Orders@mydeedpoll.co.uk quoting your order number so we can locate it easily.

Because we prepare customised deed poll documentation specifically for you — once we’ve begun processing your application, we cannot offer you a refund. A deed poll would be classed as goods “made to the consumer’s specifications or which are clearly personalised”, and thus it’s exempted from the right to cancellation under those regulations.  This means that you cannot return your deed poll documentation to us for a refund. This in in relation to regulation 28(1)(b) of the consumer contracts (information, cancellation, and additional charges) 2013.

This doesn’t, however, affect your right to a refund under to the terms of our acceptance guarantee.

Corrections

Corrections due to our errors are rectified promptly at no extra cost. However, corrections resulting from applicant error a new order will need to be placed with the correct details for this to be sorted. Refunds are issued within 5 working days using the original payment method.

 

If your deed polls were lost in the post

In the event that your order does not come in the post we will re-send the order one time without charge.  This is the limit of our liability.

If your documents were sent —

  • by 1stClass / 2nd Class, we’ll re-send them after 2 weeks (10 working days)
  • by Recorded (“Signed-For”) 1stClass, we’ll re-send them after 2 weeks (10 working days)
  • by Special Delivery, we’ll re-send them as soon as they are overdue(although they will be considered lost after 1 week (5 working days))

 

  1. Complaints

We welcome feedback and address complaints promptly. Please reach out to our customer service team for assistance, info@mydeedpoll.co.uk.

We aim to respond to any e-mail as soon as possible, but at most within one working day (our working hours are 9 a.m. to 5 p.m.).

  1. Statutory Rights

Your statutory rights remain unaffected by these terms.

  1. UnforeseeableCircumstances

We are not liable for delays or failures beyond our control.

  1. Limitation of Liability

While we strive to provide accurate information and services, we disclaim liability for any consequential or indirect damages arising from the use of our site.

  1. Availability of Services

We endeavour to maintain service availability but cannot guarantee fault-free operation. Any service interruptions will be addressed promptly.

  1. External Links

We provide external links for informational purposes but disclaim responsibility for the content of linked sites.

  1. International Use

Charles Burgess makes no promise that materials on the My Deed Poll site are appropriate or available for use in locations outside the U.K., and accessing the My Deed Poll site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

English law governs our contractual relationship, and English courts have jurisdiction over any disputes.
